9.Photos depicting content including but not limited to the following are barred from participating: advertising, pornography, immoral or unethical images, animals, collages, prominent public figures, models, cartoons, photomontages, animated images, images with superimposed Internet or e-mail addresses.
10.Photo submissions are only valid when they have a maximum size of 15MB and are provided in the following formats: JPG, GIF or PNG.
11.You will have the chance to have your photo or other material you upload exposed as part of a banner promotional campaign for Avril Lavigne Fragrances in websites outside of www.avril-lavigne-perfumes.com. This will be done only if you explicitly request your photo to be used for that purpose. You bear all the risks associated with such exposure of your photo including but not limited to risks of any connotation between your photo and the content of such other websites, within undetermined period of exposure, as those matters may be beyond Avril Lavigne Fragrances control. 3.Participating in the contest is restricted for employees of the Procter & Gamble group of companies and immediate relatives or family members.
4.The winner of the Top prize will be the one achieving a higher number of Black Star points at contest closure date on January 1st 24:00 CET
5.The winner of the monthly prize will be the one whose poster achieved a higher number of Black Star points at the end of the forepassed month starting as of June 2009 until December 2009.
6.In the event of a tie (same number of Black Star points) the participant achieving the highest score earliest in time will be the winner.
7.All points collected shall be reviewed for irregularities and, if applicable, deleted.

10.Winners of the monthly prizes compete for the Top Prize on the same terms as all other participants.
11.The monthly prizes will be sent to winners via post upon confirmation of the winner’s address via email.
12.The top prize will be the opportunity to attend an Avril Lavigne concert during her next global tour and meet Avril Lavigne in person backstage afterwards. The winner can be accompanied by one selected person.
13.Exact time and location of the concert and meeting will be communicated to the winner upon confirmation of Avril’s tour schedule. The best effort will be made to ensure the meeting happens at the soonest date after contest closure and the location of the meeting is closest to the winners residence address. However the final choice of time and date will be made solely by Avril Lavigne Fragrances. If the winner for whatever reason is not available for the meeting at the suggested time and location, Avril Lavigne Fragrances shall bear no responsibility for that, no alternative time/date shall be offered or compensation granted.
14.If the winner is under-aged according to the winner’s country of residence legislation, and if obtaining the prize requires traveling, the traveling companion will necessarily need to be an adult acting as the minor’s guardian.
15.Avril Lavigne Fragrances will organize and cover the expenses for the traveling required to attend the concert as follows:
(i) Flights for 2 people and the guardian (in case of underaged winner) from the closest airport to the winner’s home address to the closest airport to the concert location (flight arrangement and travel class determined by Avril Lavigne Fragrances). If the concert is in the same city or near to the winner, alternative travel arrangements by public transport via bus or train will be made.
(ii) Hotel & meals organized for a period of 1 or maximum 2 days (lodging arrangements determined by Avril Lavigne fragrances; maximum meal budgets may apply)
(ii) Transport cost from home to airport, and upon return from airport to home, will be paid by Avril Lavigne Fragrances upon proof of receipt with a maximum of 2 x 50 euro per taxi (costs exceeding this amount may be covered subject to prior approval by Avril Lavigne Fragrances).
16.All other costs, even those unexpected, not listed above are not covered by Avril Lavigne Fragrances/and must be borne by the participants themselves.
17.Avril Lavigne Fragrances shall not be liable for any delays, changes, disruptions, cancellations, diversions or substitutions or any act or omission whatsoever by performers or events or by any form of transportation and/or accommodation included in the prize
18.The winner is responsible for their own insurance during the full days of travel and the event. Avril Lavigne Fragrances is not responsible for taking insurance nor liability for the winner.
19.The winner of the Top Prize and of each monthly prize agrees to accept to transfer his name and image rights for any Avril Lavigne Fragrances related promotional activity (TV, advertisement, POS materials, website and presence at PR events) before and after the Avril Lavigne Fragrances Black Star online contest, free of charge i.e. without royalty or remuneration for this transfer of rights.

21.The winners of the monthly prizes and the winner of the Top Prize will be notified about the winning in writing via email to the address specified in registration for the Community . Failure to respond to the notification email within 60 days, will imply that the winners are not interested in receiving the prize and will loose the right to receive it.
22.Any taxes, duties or other charges that are due from the winner as a result of winning the Contest must be arranged and paid by the winner. Avril Lavigne Fragrances bears no responsibility for such payments and does not provide any compensation related to it to the winner.
23.Avril Lavigne Fragrances shall not be liable to the winners or their legal representatives for any loss or damage or injury to the winners or their property caused or suffered in connection with the Contest and/or prize unless caused by the negligence of Avril Lavigne Fragrances and recoverable on that ground.
